In Staaten mit einer Kriegsmarine war dieses Gericht kein stndiges, sondern nur im Falle eines Krieges oder einer Blockade gebildetes Gericht. Es entschied ber die Wegnahme von Schiffen, Gltigkeit und Bruch einer Blockade usw. In diesem Fall wurde es auch Prisengericht genannt. ber die Zusammensetzung der Prisengerichte in Deutschland wurde nach dem Reichsgesetz vom 3. Mai 1884 durch kaiserliche Verordnung (z. B. vom 5. Februar 1889 fr die ostafrikanische Blockade) bestimmt.
