Der Optionsvertrag wird zwischen einem Optionsgeber und einem Optionsnehmer geschlossen. Er begründet eine Bereithaltungsobligation. Mit ihr ist ein Optionsrecht verbunden, welches der Optionsnehmer während einer vereinbarten Optionsfrist ausüben kann. Eine solche Ausübung führt einen von den Parteien des Optionsvertrages festgelegten Hauptvertrag unmittelbar herbei. Bei entsprechender Vereinbarung schuldet der Optionsnehmer dem Optionsgeber als Gegenleistung eine Optionsprämie.In der vorliegenden Doktorarbeit wird der Optionsvertrag untersucht. Im Fokus stehen die einschlägigen vertragsrechtlichen Themen. Konkret handelt es sich dabei um die Erfassung, das Zustandekommen, die Gültigkeit, den Übergang, die Störung und die Beendigung des Optionsvertrages.
