Die Arbeit untersucht die in Investitionsschutzabkommen enthaltene Zustimmung zum Investor-Staat-Schiedsverfahren und die Frage, ob Staaten diese einseitig zurcknehmen knnen. Sie analysiert die Funktionen der Zustimmung, typisiert ISDS-Klauseln anhand der Vertragspraxis und beleuchtet ihre Rechtsnatur im Verhltnis zum Investor. Die Zustimmung wird als vlkerrechtsunmittelbares Individualrecht qualifiziert, das Investoren den Abschluss einer Schiedsvereinbarung ermglicht. Besonderes Gewicht kommt der kollisionsrechtlichen Perspektive zu, die bestimmt, welches Recht auf die Zustimmung im Verhltnis zwischen Investor und Staat Anwendung findet.
